January 15, 2009 - Dave Basi's case continues in Victoria Provincial Court

Comments:
How do you know that the secret witness hearing will be televised??

You may need to do some more research on that topic.

.
To Anonymous 9:51:

If you have better information, share it.

Bulletin: You are not the boss of me. OK? Do your own research.

However ... in the spirit in which I trust your question was intended, I can tell you as follows (and you'd know this if you do any research on this blog yourself):

All Supreme Court of Canada hearings are televised.

The appellant must request, for good reason, a TV black-out.

Berardino hasn't done so.

OK?

We'll be waiting to hear from you again.

.

you have posted on your blog that the April 22 hearing will be televised. By what information do you have to prove this?

Bill Tieleman had mentioned that there is no chance in hell that this case will be televised.

So Mary, why are you so sensitive to someone asking where you have found out facts that others have determined are not entirely correct??

.
Get a grip, 12:55,

This web-site is not about me. Surely, in almost 3 years of free access, you've noticed that?

I think Bill will be proven correct in the long run. I mean, think about it: how could they possibly televise a SCOC hearing and still keep the identity of that secret witness a secret? (Maybe they can. I don't know. Do you?)

But there are procedures and developments, one slow step at a time, which I think you undestand.

And at the present time, I believe there's the standard "All SCOC sessions are televised" in place ... until ... Bill Berardino applies to have a closed session ... and so far as we know, Berardino hasn't done so.

Can you handle that? Or would you rather squabble about who said what.

You sound like you're paying $250. a year for this subscription and you feel you aren't getting value for your money.

Good one, 12:55.

Now I have a serious question for you: why your anger?

.

Mary, this anon is wrong. And I just want to alert you to the post I made awhile ago.

The SCC televises all hearings. The BC Appeal Court heard Berardino's first appeal in public without a publication ban and with the media and public allowed to attend and report on the matter.

At this stage, there is no discussion of the identity of the secret witness. The issue Berardino is challenging is allowing the defence to attend a closed hearing where a police officer will discuss the information that the secret witness offered to the police. See Justice Bennett's decision of Dec 2007 that started the Russian doll situation of Berardino's appeal after appeal.

Mary, you may wish to post my earlier posting which I stand behind and look forward to defending if it is challenged!

Keep up the great work and i would pay a subscription fee for this website.

PG,

I'm so thankful for your clarification on this topic.

It cheered me up no end.

Best wishes!

Thanks for the clarification.

And....

I just had a very scary thought...Could it possibly turn out that Mr. BB will use his own lack of 'lack of application' as the justification to apply for another delay down the road?
