SPECIAL PROSECUTION TEAM UNDER SCRUTINY

Bombshell allegations were under discussion during the last two days but I believe that I can only write on what was said in front of the jury.

Justice Mackenzie told the jury members that a man approached 2 members of the jury at a Skytrain station. She then advised the 12 person jury that this person has absolutely no connection to the 3 defendents, their counsel, their supporters or any witness. The man in question is the father of one of the Crown Counsel prosecution team. (One member of the Special Prosecution team was not present at court today - Andrea Mackay.)

This shocking revelation caused the gallery to stir and forced the Judge to tell the jury that this "Won't happen again!"

The jury was asked if they can continue and they all agreed. This type of situation could not be dreamed up.

Any contact with a jury member risks the allegation of jury tampering.

This is outrageous behaviour and I beleive that the Special Prosecutor and his team need to be held accountable.

Unfortunately, nobody in the accredited media will ask the tough questions of Mr. Berardino. For example, what did the Special Prosecutor know and when did he know it? I can assure you that if a blogger approached a member of the jury there would be howls of outrage from the Crown and the RCMP and a full investigation would take place.

Another shameful day for so called "justice" in BC.

Things have gone from weird to truly bizarre.

Keith Fraser at the Province is reporting that two RailGate jurors were approached by the father of one of the prosecutors at a skytrain station and, as a result, the judge has gone out of her way to assure the entire jury that it was not anyone associated with the defense and that it will not happen again:
 Amazingly Glow Ball Snooze at Six actually mentioned the Patterson Station "Approach" with a 20 second interview that allowed David Basi to express his horror that the prosecution would engage in such tactics. 

Even more of a treat is the observations of North Van Grumps who was also in the courtroom and seems locked in a mano a mano battle for the Peoples' Pulitzer with the Citizen Journalist from 54! NVG's stuff is here at the Gazatteer's comment thread!

Incredible gall. Incredibly inappropriate.

The jury's sanctity should be being protected by sequestering them, if it's so bloody important, and not to expose them to the vagaries of the public, or the public media. Lock them up in the Howard Hughes suite in the Bayshore, give them Faye Leung for entertainment purposes, and let the rest of us see what's going on without a publication ban.

What are jury members doing taking Skytrain? Shouldn't they be being ferried by Sheriffs?
 
This would certainly be a scary situation for anyone at a Skytrain station to be approached by a man out of the blue. Was he stalking them?

I wonder if any sanctions can be laid by the court to the Special Prosecution team. They are clearly unfit to continue prosecuting this case.
 
C'mon, give the accredited media a break. Do you know how hard it is to get Berardino to say "boo" to anyone. If he talks to the media at all, he insists it be off the record. There is no point in asking him any hardball questions as he won't answer them.
 
This is turning into a regular gong show. What next? The Soup Nazi having a barbecue with the jurors to celebrate their dedication to the best place on earth.

How so these people look in the mirror?

That's just the thing....

It wasn't the prosecution that informed the judge.....

It was the JURORS THEMSELVES.

Thus, not only does Mr. Berardino's team not speak to the public, it would appear they also don't speak to the judge herself.

So how did somebody's father know the two people were jurors on that particular case? I rather doubt that the average citizen knows the names of the jurors yet somebody just happened to meet them at a particular train station.
 
I think the more interesting thing about the SP's father is that he has attended the trial almost daily for several years and since the defendants have been in the box has always chosen to sit directly behind them within listening distance. Because of the glass booth this is a difficult place to listen to the trial but the best place to listen to the defendants conversations.
 
One thing that hasn't been mentioined is that along with the one special prosecutor's father, the other special prosecutor's daughter was also a regular in the gallery. After the incident at the Patterson Skytrain station, she also stopped attending the court sessions. As far as I know, no relative of Berardino has ever attended court case.

Wow...just how scummy can it get when you have a "daddy plant" sitting behind the defendants? Guess he takes the place of Chase huh?

Or does he take the place of integrity? Not the the Prosecution team understands the meaning of the word methinks.
