BASILEAKS. BC Rail. The Struggle for Power in British Columbia

First, readers must know that memos alleged to have been written by Dave Basi in the Fall of 2003 have been and continue to be leaked by a blogger. (Basi was convicted in the BC Rail Scandal Basi, Virk, and Basi trial on October 18, 2010.) 

The memos deal with the policies and behaviour of some top actors, as well as Dave Basi and Bob Virk, in the corrupt transfer of BC Rail to the CNR.

The appearance of the leaks open, perhaps, more questions than  answers.

The memos answer, partially, questions about high-level manipulation to misrepresent the transfer of BC Rail to the CNR.  And they will suggest – to some – that earlier allegations of breach of trust among high-flying players may rest upon solid ground.

Leaked to a blogger, they open serious questions about their source and the reasons they have been leaked. Those questions are very important.

If they were leaked by Dave Basi himself, the reasons would probably be to keep the BC Rail Scandal pot boiling, to force attention to involved senior operatives giving Dave Basi and Bob Virk orders and directing their actions in a process that seems – more and more – to have been improper.

It might be Dave Basi saying: “I told you so” about Defence allegations that the three accused were pawns, were targetted, and took the fall for more powerful, top politicos and their friends.

But if – as has been suggested – the leaks were initiated by someone close to the RCMP and/or the Prosecution, the questions become very different … and more serious.

Investigation by the RCMP in the matters of the BC Rail Scandal has been widely … and deeply … questioned.  Why did the RCMP terminate without record their investigation of finance minister Gary Collins in mid-December 2003?  Why did they announce in late December 2003 that no elected officials were being investigated – though deputy premier Christy Clark was served with a search warrant (as was her brother) on December 28, 2003?

Why did the RCMP take a full year to “complete” investigation during which – apparently – all elected officials were put aside or ruled out?  How could RCMP spend another full year of investigation without involving elected people deeply involved in the corrupt transfer of BC Rail to the CNR?

Was RCMP investigation chief Kevin Debruyckere discussing matters with his brother-in-law Kelly Reichert, top BC Liberal Party officer and familiar of Gordon Campbell, premier … as Defence counsel alleged?  Why have we no answer about that?

Why, later, in the pre-trial hearings did the RCMP – as Defence alleged – stall, delay, and scramble production of disclosure materials needed for the Defence of the accused?

If the RCMP is responsible for the leaks of the Dave Basi memos to a blogger, they may be trying to force attention away from their own role in the BC Rail Scandal investigations.  As alleged servants of the Gordon Campbell cabinet, they may be trying to force attention away from themselves to an apparently central role – as Mr. fixits – played by Dave Basi and, to a lesser degree, Bob Virk.

If the leaks were arranged by someone close to the Prosecution, a similar attempt to shift attention may be at work.

The Special Prosecutor in the case was wrongly appointed – in a violation of the legislation governing the appointment process.  Mr. Berardino’s appointment, though wrongful, may have been anodyne.  That is, it may have been simply a matter of friends helping a friend – fully intending that he would pursue justice with unstinting integrity.

But – of course – a wrongful appointment opens questions.  What if, instead, he was appointed to protect senior wrongdoers?  What if he was set up to help “target” the accused, to assist in stalling, delaying, scrambling disclosure materials sought by the Defence?  What if he was directed to effect an unseemly deal to shut down the trial  - in order to protect Gordon Campbell and his associates in a corrupt transfer of BC Rail to the CNR?

If those questions are real, then Prosecution (‘the Crown’) might well want (1) the accused to seem like wrong-doers deep in manipulation, (2) the charges against them to appear to be visibly deserved, and (3) the role of the Prosecution thrown into a perspective that makes it seem untainted.

A further question presents itself.  If the leaked memos exist as part of materials held by the Crown, the RCMP, and/or the Defence, why is there no alarm expressed?  Why isn’t the court – so quick in the past to protect secrecy, disclosure materials, and the farthest outreaches of the publication ban – why isn’t the court ordering all the material that is being leaked sealed immediately under threat of Contempt of Court?

Does the Court want the Dave Basi memos made public?

To date, application has been made to have the Court order all materials that have been disclosed to Defence returned to the Crown.  But that application hasn’t yet been heard fully. A decision has not been made.

Disclosure materials, then, are in limbo – and are not presently at the disposition of anyone who wants to cast them into the public arena.  Does that mean the Basi memos are not part of evidentiary materials held in the case?  If that is true, where did they come from to be leaked to a blogger?

Why is Associate Chief Justice Anne MacKenzie silent about the on-going leak of the Dave Basi materials obviously relevant to the BC Rail Scandal and the trial of Dave Basi, Bob Virk, and Aneal Basi?

Who provided the Dave Basi memos to a blogger who is making them public?  That is the key – and so far unanswered – question.

[The Blogger. Observers may fairly and objectively want to know on which part of the political spectrum the Blogger is located.  My informants suggest he would probably be a long-time federal (Stephen Harper) Conservative who, for a time, took membership in the equally Rightest BC (Gordon Campbell) Liberal Party.  Now, the Blogger is said to have no formal affiliation with a political party.  My informants tell me, however, he rarely writes  with sympathy about the NDP, and rarely writes flatteringly of anyone he believes would be found on the Left half of the political spectrum.  Observers, then, may fairly and objectively ask who – wanting to leak the Dave Basi materials – would deliver them to a Blogger on the Right end of the political spectrum?]

Then there was a 2nd comment, this time from Don F., saying the Christy Clark search warrant is an error:

I have been reading these articles for many months and must advise you that this is also the first time I have heard this mentioned. Perhaps worth your checking in this matter,

I am not a Clark fan by any stretch in fact I wish what you say to be true but see this as exactly the type of credibility mistakes they would love to cite against bloggers.If you are correct my apologies! With all due respect!

Dear Mary.  As you know, I don't usually answer comments made on your site.  But this comment requires an immediate answer.

 If there was no search warrant, as Mr. Jackson Smith says, "ever placed on Christy Clark", that fact needs to be made absolutely clear. Without delay.

In the search warrant looseleaf folder released on September 11, 2004 information is given regarding the "Information to Obtain dated December 24, 2003."  That was the time when the Legislature 'Raids' search warrants were gained  - and for several to other places around Victoria and Vancouver (used on December 28, in fact). 

The September 11, 2004 document reports that "of the information to Obtain dated December 24 ,2003, there is a list of individuals whose names appear within the document.  The fact that various individual's names are contained within the document should not be taken as an indication that those individuals are under investigation".  That statement was made and signed on September 10, 2004 -  more than eight months after the original search warrant 'raids'. The list contains 20 names of which two "are at the present time subjects of this investigation", and they are David Basi and Bob Virk. Among the other eighteen, Erik Bornman, Mark Marissen, Bruce Clark, Gary Collins, and Christie Clark are named (among others).

The looseleaf folder then reveals some search warrant material, naming Dave Basi, Pilothouse, Erik Bornman, BC Govt Server, Bruce Clark, and several Legislature locations (six uncensored pages).  

Then follows a synopsis by Corporal A. T. Cowan with some parts blacked out, identifying 'sources of information', and repeating the list: "That the following persons have been identified during part of the Project "Everywhichway" Investigation, and are referred to in this information to Obtain a Search Warrant." The names on the list are the same as the ones named in the preceding paragraph here (except that - by error I believe - the name of Keyvan Shojania appears twice).

In that - at first - not heavily blacked out portion Mark Marissen is referred to as "the husband of BC Government MLA Christie Clark" and is mentioned in relation to Dave Basi.  Bruce Andrew James Clark is referred to as 'the brother of BC Government MLA Christie Clark" and the director of VOBIS Consulting Group.

That part of the synopsis takes about 13 pages (various parts blacked out). At the point that the reference is to VOBIS Consulting Group and  to Bruce Clark as "sole director", the text following is blacked out completely for ten pages. 

Then about a half page is un-blacked out. Corporal Cowan (if a new name hasn't been introduced in the blacked out pages) writes "That based on a review [next words blacked out] I believe the following in relation to the named offences has taken place...."  Then four paragraphs refer to Basi and Virk.  And then the following, next forty-five pages are blacked out.  And the four after that are mostly blacked out.  And it goes on... farther.

There follow (and I don't itemize because of space) many pages containing Warrant to Search, Warrant To Search And Related Assistance Order materials. 

In one, entitled "INFORMATION TO OBTAIN A SEARCH WARRANT", taking up fourteen pages  - of which four are completely blacked out and six partially blacked out - the following appears after four and a half completely blacked out pages:

"DECEMBER 28, 2003

38. That members of the RCMP Commercial Crime Section attended the residence of Mark MERISSAN and BC Government Deputy Premier Christie CLARK.   Mr. MERISSAN was spoken to by S/Sgt BISHOP of the Vancouver Commercial Crime Section.  Mr. MERISSAN was in receipt of a list forwarded by BORNMAN containing the names of BASI and VIRK for federal government jobs.

39.  That I reviewed the notes completed by S/Sgt BISHOP and the following was stated by Mr. MERISSAN...."
        ....
 [No further reference is made to Christie Clark.]

In the material from which I have quoted, the document is named: INFORMATION TO OBTAIN A SEARCH WARRANT.

In the material which follows (much of it blacked out) the document - INFORMATION TO OBTAIN A SEARCH WARRANT - then reports RCMP officers "attended the residence of Mark MERISSAN and BC Government Deputy Premier Christie CLARK".  Since I could find no statement that ONLY Mark Merissan was the subject of the 'Information to obtain a Search Warrant', I presumed both people named were included or that the RCMP would have indicated otherwise.

[The change in the spelling of Mr. Marissen's name was undertaken by the RCMP.]

I am perfectly happy to be shown that I am wrong.

Comments:
While interesting to say the least upon reading this article I am struck that is is a series of many questions based mostly on assumption and relying on informants.
Certainly these are valid questions for the most part but answerable only by those who were involved personally and until this comes forward assumptions are just that assumtions.
Given thought as to why Justice MacKenzie is being silent about a leak,one logical reason that comes to mind is that perhaps it is out of her jurisdiction, perhaps Mr. Basi placed these in the hand of someone chosen by him to be released according to his instruction at a given time and these memos were never part of evidence provided to the courts? I don't know but that could be a probable logical assumption.
I feel the hint of personal lashing that will serve little to bring all of this forward and only serve to confuse as no one seems to have answers at this time only more questions.
Given the delicacy of the entire situation in which these memos are a part I find I personally choose to take some deep breadths, concentrate on an open mind and ask for patience as I am sure in time we will have our answers,I am choosing to take everything I read in with that open mind and trying to absorb what 'truth' can be drawn from all before me.

Go back and read each release of these memos and you will notice a constant. I am referring to AGT’s writings, not the memos themselves. Every name and every action he references is worked to implicate Christy Clark. He has a big time hate on for her. I do not know what she did to him but it is pure venom. I believe he is more interested in destroying her reputation than revealing the truth about the Raid on the Legislature. The supplier of these documents has the same objective. Just one opinion!

Of course Christy was going to be called if the trial continued. Of course she would have to face the choice of truth or perjury. That much has always been clear.

But there is a deeper story behind all of it that was indicated in a comment left on Yuiles blog a couple of days ago.

" The control of rail lines to “coal” is a “Peak Oil” hedge until zero energy or tidal see-saw pump dynamics seen as super hydro. This is “military” school to Wharton control distribution supply line exploitation and “not just a train sale”. This is so much bigger.
6 million in legal for little league lobby punks? Aiding and abetting criminal acts and conspiracy to defraud can not be legalized by court rooms as just too obvious an error in legal reasoning. Provincial treason. A political renaissance, revolution and reformation bubbling see polls. Oppourtunity."

Basi leaks is not about BC rail, it is about taking out a candidate who is both a provincial liberal AND a federal liberal. Christy Clark.

Stephen Harper and Falcon invested a lot of stimulus money in the Gateway Project, which if you look around,is the key western link to the canada wide gateway initiative.

Harper is a Conservative through and through,Falcon is a known federal conservative,the majority of his south surrey backers are federal conservatives as well.

If falcon loses the leadership bid to a candidate who loves and is a member of Ignatieffs minions,all that Harper has invested here stands to be lost, as does the Fed con hold on BC.

Someone who felt that individuals connected with the NDP might time their release to maximize political advantage, instead of releasing them as quickly as possible? (Not that AGT isn't doing something like this ;-)

AGT mentions the source as someone close to the horsemen and the prosecution, who's appalled by the corruption and manipulation of process.

A probable right-winger preferring to deal with another right-winger, perhaps?

Personally I think the whistleblower's reasons for leaking are a lot more interesting than the fact that he chose AGT, although maybe there's a shared agenda related to a third party.....

Here's Alex G. Tsakumis in his own words as he began publishing Dave Basi's Memos to File:

"Some time in early November, after the obvious deal cutting between the B.C. government and co-defendants David Basi and Bob Virk, I received a phone call from someone close to the prosecution and very familiar with the BC Liberal government, who was appalled by what had just transpired.
A long-time retired lawyer with a storied reputation when he practiced, this wasn’t a man who was going to suffer the spin zone, and for reasons which, in part, are entrusted with him and his client, they provided me with several bankers boxes of information related to the sale of BC Rail.
We met several times over the course of a week. He explained his position and that of his client as I listened.
After several more meetings, I traveled to Nanaimo, where he introduced me to the man who delivered what I refer to as ‘The Basi Files’.
Over the next week or so I will release one ‘Memo-to-File’ per day. They are authored by Dave Basi alone, in his own words, and after he wrote each installment they were witnessed by Victoria lawyer George Jones, Q.C. whose unimpeachable integrity is without question and whose signature I have verified.
The memos are dated from October 6th., 2003 and extend almost two months to November 25th., 2003 (the day after the sale of BC Rail to CN was formalized)."

Now, to begin, i would suggest that someone contact Victoria lawyer George Jones, Q.C. in ordeer to verify the authenticity of his signature as the witness to these "memos to file."

"A very interesting bit on Alex Tsukamis’ website today. It’s another ‘memo to file’ from Basi, witnessed and dated to November 17, 2003. And it covers a conversation between Liberal Party executive director Kelly Reichart and David Basi regarding the role of Patrick Kinsella in the BC Rail deal.

The allegations made in the memo have pretty well been revealed. The memo purports that Kinsella was working directly with Campbell, Martyn Brown and David MacLean at CN on the BC Rail sale. That tight group also happened to be the chief fundraiser, chief strategist, campaign manager and Leader of the BC Liberal Party in both 1996 and 2001.

If true we’re talking Quebec style public adminstration.

What I find interesting is the date: November 17th, 2003. That means this conversation – if it took place – was caught on wiretap and is part of the investigative record examined by the RCMP team headed by Reichart’s brother-in-law, Kevin deBruyckere.

A host of questions are raised if this is true. For example: isn’t it legally troubling that a key party official is privy to the tax structure of a government deal still in negotiation? Basi’s report of the conversation says Kinsella leaked that information to Reichart. To what end? Isn’t that legally questionable? Why wasn’t that investigated if the RCMP has this wiretap? What role did deBruyckere play in directing the investigation at this point? If this conversation exists, isn’t he in conflict as the lead officer? Etc…

What I really want to know is this: does this wiretap exist? Because if it does that suggest that the investigation was tailored and directed away from key Liberal Party and government officials including the brother-in-law of the lead officer.

If the RCMP seeks the return of this evidence in court as rumoured, that will give us a big clue that this wiretap or something like it does exist."

Of course "it" is a larger question.

Of course "they" aspire to greater mischief. You think we don't know that?

But BC Rail is/was ours. It is the key for British Columbians. It's the key which can begin to open doors and to lay charges.

I'd say we have a duty to challenge whoever arranged this bit of train-robbery.

Or would you rather we pretend how wise we are, and do nothing? Let me guess: Is this the Krog School of Political Action?

Don F. asks why Justice McKenzie has been silent about the leak of purported Basi memos. One clue to her silence may be to read Norm Farrell’s latest piece on Northern Insights (http://northerninsights.blogspot.com/ ). It’s about the conduct on another BC Supreme Court justice, Leask, regarding major drug rings in BC.

One need not labour too long in considering the possible connection to the drug-fuelled start to the investigation into the BC Rail Heist. But the article also speaks volumes about the state of competency and trustworthiness of the BC judiciary.

Norm’s article is bristling with facts and evidence of the highest official condemnation of Justice Leask for his serial misconduct. After reading it, one has to wonder why nothing has been done to remove this judge?

One inescapable possibility comes to mind: the BC judiciary has lost its moral compass. And, it's not just one judge, it's become more widespread and more flagrant than a few "bad apples".

How Mathews can speculate otherwise shows you how biased his reporting is "three brown men" etc.
 
The commenters who point out the anti-Christy, by default pro-Bird Brain Falcon agenda behind the "basi memo" releases make a lot of sense to this observer. Of course the gross tattooed man could bear a grudge over some past spurned advances, which would be pure speculation of course.

Methinks AGT doth protest too much and somewhat disingenuously when he tries to discredit Robin for referring to him as a former BC liaR ministerial assistant. Everybody not in a coma realizes that the current BC LIEberals are nothing more than the old mini-Wac/VZ SoCruds using an alias with some Reform, Western Alliance and other Canadian Taliban types thrown in to pad the numbers because these fringe right wing whackos wouldn't get far under their "real" names either and could hardly join forces with the NDP.

All the above being said, the release of these memos is a good thing, though they don't really bring much new to the table for those that have been following this affront to decency and democracy ever since 2003.

It is interesting what 'watching from afar' has to say about what he believes to be the federal connection to the leaking of these memos.

It could explain why Nettleton supported Christie Clark as well. Though I found his decision surprising to say the least, perhaps this is part of the battle strategy being developed for the next federal election, with the Harper Conservatives/Falcon forces seeing an opportunity here to gain on the Ignatieff/ Christie Clark Liberal forces. (Though I don't think Christie Clark's record in office makes her a Liberal - even though she fancies herself as one.) And perhaps, and again, this is just surmising on my part, Nettleton being both a true provincial and federal Liberal himself, saw the stage being set in this certain direction, (a Harper/ Falcon solidarity) and weighed in in a public way, for reasons that may be ones of simple Liberal support, or for more 'complicated' reasons we can only continue to surmise over.

With a "targeted" investigation, it may be only so relevant just where and upon whom search warrants were executed. The fact remains that documents were found in the possession of Bruce Clark and I seem to recall something about Mark Marissen being asked politely for advance permission to seek documents at his home or office. Now I don't know if he and the female version Gordon Campbell were still married, separated or ? at the time of the raids.

It is also interesting that the offices and files of the recently under surveillance Finance Minister Collins and/or Transportation Minister Judith "seldom seen anymore" Reid weren't included in the search at the Ledge on December 28, 2003- why not has never been explained.

The fact is that many venues that could have been searched WEREN"T and some that were had advance knowledge of the impending raids.

Also Don, when will we expect the "real" journalists and reporters to be accurate in their so-called reporting of the news. They are certainly no more accurate than many bloggers either through outright making up stuff, or simply by omission by ignoring relevant stories or aspects of stories. You also can't deny that these sorry excuses for journalists also have access to resources for checking their facts that the average blogger simply doesn't have, but would certainly take advantage of, if they had access to them!

Please allow me to put up Norm Farrell's latest piece one more time. It's a must read to begin seeing how the mob rules the judiciary, too.

I've been busy ... and if Norman Farrell's latest piece dropped off the trolley, well, thanks for picking it up again.

It's a terrific and alarming piece of work, and as a result,

I've worked on something throughout the afternoon, connecting a few dots I hadn't noticed before. It all helps.

How Mathews can think that Basi somehow released these memos to advance some point is ridiculous theatre at best, evidence that Basi has sucked in Mathews hook line and sinker, at the least.

Basi took bribes and gave information. yet here is basi writing memos to the effect that "if I ever find out who did this" bs it is so obvious what what he was trying to do, ie cover his tracks.

That Mathews doestn get that makes me wonder why his long-winded ramblings get respect from anyone, except maybe the uninformed, or the too nice and polite to tell him like it is.
 
Has anyone contacted George F. Jones QC at 'Jones Emery Hargreaves and Swan' to discover if these 'Memos to File' are even legitimate--?

Why doesn't somebody drop him a line and make a little enquiry about these memos.

I've read through them all, thrice; and, to my nose, something smells off and George Jones is the guy to begin asking about them.
 
Mt Man, I can see where you might think Basi is trying to cover his tracks with these memo's IF they had been written "after the fact" but that is not the case.

The memo's were written during the planning and the completed theft of BC Rail...that makes them current to that time frame. I've read them, and in more than one instance one can see that Mr. Basi appears to be becoming a worried man. With good reason.

Is what he did wrong? Yes. But that is NO reason to allow those who were pulling Basi/Virk puppet strings to exit stage left. I'm quite sure that had Basi been able to see what was planned for both he and Virk, the game would have played out much different.

Also, your assumption that Basi is the one to reveal these memo's is just that - an assumption. AGT has not, (and I doubt he ever will) released the name of the person/s who gave him those memo's. Those memo's alone make it crystal clear - there must be a FULL and OPEN public inquiry (with consequences) in the sale of BC Rail.

In the light of my memories from the time, and Robin's comments now on the front page, it would appear that Mr. Jackson and the others who claim no warrants were ever issued on Christy (or her close associates) are indeed the ones either in error or more likely LYING with motive!

Mr. Man, your comments are beneath contempt, and unworthy or response!
Perhaps you suffer from ADD. Perhaps you should read the memos, if you are capable of doing so, and the commentary that accompanies them - which has NOTHING to do with Robin Mathews.
 
Leah, I never said basi revealed these memos. Mathews advanced that possibility.

the memo was clearly written by basi to cover his tracks, after the fact.

See "The Integrity of ‘The Basi Files’ and a Challenge to Christy Clark", posted by Tsakumis on January 6th.

AGT verified George Jone's signature via publicly available court documents. He finally called him on the 5th and transcribed the conversation in his post on the 6th.

George Jones has nothing to gain from lying about this, and has an excellent reputation in the Victoria legal and business community.

So there's little doubt that these are the memos that Basi had Jones notarize in 2003. However, that shouldn't be taken as endorsement of the veracity of the memos. It merely proves that Basi approached Jones with those papers in the fall of '03.

I must say that i find your response to me a bit shocking!I assure you I have read the memos, every last word of them and am literate and more than capable of understanding every last word.
I don't understand your attack here to me so am left with little to fight back with, perhaps if you could single out exactly what your problem is? What have I said here to deserve such a lashing from you?
I would suggest you go back and read what was said here and and try to comprehend it as it was intended, someone trying to point out a possible error here.
My hope would be that we can all get along in our fight to bring out the truth in the BC Rail sale, if for some reason you don't want that then I don't see it as me who has an agenda, but you, and I will keep that in mind in the future.

It seems I am in error in reading what you wrote to me and I feel now I must apologize to you for that.
I took my own advice and reread my comments and your communications to them and I now believe I was in error in reading them. In your last response where you refered to Mr. Man, I took this to be further communication to me. I hadn't seen the post by one MT. Man to whom I now think those word's were meant and I was puzzled as to why you were saying that to me.
I had my wife reread this thread in hopes she could figure it out and it was she who picked up on my mistake.
Sometime writing on blogs is not something I relish and surely can and have been known to make mistakes as it is so inherently easy to take something totally out of text especially when included in the same reply> Add to that my inadequate computer skill and illiteracy of the same and things happen. At any rate I think I see this more clearly now and extend to you my apology if I misunderstood.

Don F. - You are correct in your second reading - I was merely pointing out to you that there is evidence to indicate that Christy and her close associates (or family members) WERE the subjects of search warrants - though everyone that mattered (ie not "brown men") seemed to receive advanced warnings (allowing time to remove incriminating documents) or polite requests for a look see rather than a surprise raid as happened to the offices of Basi and Virk at the Ledge.

It was Mr. Man that I was asserting was making comments beneath contempt - a position I still hold to be true!
