Given what you know today about BC Rail, does this sound right to you? Robin Mathews replies: Yes!

BC Mary explains: With Robin Mathews' permission, I have posted something he wrote to another friend on the my previous posting: "BC Rail - does this sound right to you?"

Yes.  The early information provided here - "sounds right" - to me. 

                     The matter is a little more complicated than that, as I see it and have experienced it.  Mary has kept the drug aspect at the forefront because it was so closely tied to the investigation from the beginning - and, in fact, was the motivator for it at the start.  And then it was semi-split off; and as she points out the Bains trial and conviction were almost buried, as if the Crown (and its friends) didn't want it noticed, keeping the spotlight on Basi, Virk, and Basi.

                     But there is a problem.  It is the suspicion that matters were set up from the beginning to mislead the public in the whole matter.  And that nothing Winteringham says can be trusted. That suggestion is given basis by the end of the trial - when it was clearly evident that further cross-examination of the Gordon Campbell circle (as good a name as any) would reveal that they couldn't answer questions or they would prove the Defence claim throughout that big, big crimes were not the lower level misdoings of Basi, Virk, and Basi but the actions of very top politicians and their corporate allies.

                     When the court HAD TO give Defence the right to question on "connected matters" dealing with the Basi, Virk, and Basi charges [Berardino tried to get a ruling that Defence couldn't ask those questions - and even Anne MacKenzie, judge, didn't dare at that point support Berardino because and Appeal Court would have overturned her decision and slammed her for it], THAT BLEW THE TRIAL OUT OF THE COURT. The 'big boys' (as I read it) had to face grilling that they couldn't deal with because they would either say NOTHING or incriminate themselves.  I can imagine panic among the Gordon Campbell circle.  Then the rapid "deal making" with the Defence.  The three accused had REAL power in the deal-making - Dave Basi for instance insisting that all charges against his young cousin Aneal Basi be dropped completely, and they were.  And the infamous $6,000,000.00 paid (not to the Defence remember) but to the Defence ON BEHALF of the two major accused.

                     The matter is more complicated partly because of the experience I had.  First: no one of Mainstream Press and Media would TOUCH the information I unearthed that Bill Berardino was wrongly appointed, was illegitimate, and shouldn't have been in the court at all.  Even Big Hero Bill Tieleman not only refused to touch it but reported falsely on his blog or on Tyee that I was WRONG and Berardino had been cleared of suspicion! ! !  And Berardino had not been and never was.

                     The body language and actual interactions in court and in the foyer (where interviews, scrums, etc, happen) were very strange.  The three major Prosecutor people were Berardino, Winteringham, and MacKay.  First MacKay (who I always greeted and  small-talked with) cut me off and would sweep pass without acknowledging me.  (I thought that was dumb because it gave 'something' away.) That came after I began to insist in reports that Berardino was improperly in the court.  Then, very near the end of the trial, I came out to a media scrum that Berardino was addressing and he stopped, looked at me, and told me it was a private conversation, they weren't talking about the case.  I asked if the Special Prosecutor could have a private conversation with the press.  He insisted.  I went.  He came over to assure me it was a private conversation.  Then that evening, on his blog, Ian Reid who writes - is it "the Real Story" with the cow on the masthead? - wrote that he was in the scrum, it wasn't a private conversation, they were dealing with the case, and Berardino had lied to me.

                     THEN, as I see it, we got to the end, nearly, of the trial and its wrap up, and (I believe) a little piece of chicanery was set up - MSM would ask for the documents dealing with RCMP investigation only into, and only RCMP, of Basi, Virk, and Basi.  Some of it was pretty sleazy and would make the three accused look like sleaze artists.  Nothing else was to be released "to the public".  Anne MacKenzie, judge, said yes.  Then Janet Winteringham rose and said the material was sensitive and she thought it should only go to the "accredited journalists".  The court and the court's MSM committee had cut me out of the accredited journalist list.  The Defence rose and argued that if it was to be released to the public, it should not be restricted to the "accredited journalist" list only but to "the public".  (I believe the Defence got the message fast that Winteringham was trying to keep the material from ME.)  The judge didn't accept what Defence said.  I was cut out.  The Mainstream Press and Media could cut and paste the released material to protect the Gordon Campbell coterie and to keep me from seeing a shred of it.

                      And I believe that is what the MSM did.

                      So there you have MacKay, Berardino, and Winteringham, the judge, and all the boys (mostly boys) in the MSM working to keep material from the only person who was not towing the line and doing what the Campbell coterie wanted done, and showing that they were really angry with me.  Andrea MacKay started the rejection of me by the Prosecution quite early on when I began talking about the evidence that proved Berardino was appointed in violation of the legislation covering appointments of Special Prosecutors, and I laughed to myself, thinking they have boiled behind the scenes and she is too dumb to keep up an appearance that they don't care.  When they cut me out of seeing the last released material, one of the MSM reporters who'd had a fairly nice relation with me admitted he thought it was awful what they did - but he didn't, of course, lift a finger publicly. 

                      I tell that aspect of the story because there is only one person who lived it and could see what was going on.  And that person is me.  I don't like talking about myself, but I have to here, to tell the story.

And, i also thought Robin Mathews showed great courage in testifying to his peers like this. Those were rather interesting references to the roles that bill and ian have played in all of this, no?

To answer your question above, dohm's authority came as a part of the common law traditions of the British parliament. Dohm acted at the bequest of the BC Attorney General (pro forma initiated through the speaker of the house, then, Claude Richmond).

It was a brilliant legal strategy that intentionally sent the police to the people's common house so as to trigger the implementation of a series of legal checks. The insiders then took advantage of these procedures to get their guys in place and legally control the course of the investigation, not on behalf of the common weal but for the enrichment of their masters.

Consider this: Without having the legislature raids, there would have been no appointment of berardino, no authorization of dohm, and no bogus out of court settlement with basi. To miscarry, they had to breach.

So they settled on the basi angle (which was a very real aspect of the investigation but far from being even a big part of the railway robbery). In fact, i see dave basi as being set-up as a limited hang-out, a straw man character to be jettisoned if/when necessary to lend aid and cover to the bigger robbery.

When the legislature raids were executed, none other than Geoff Plant was boss at the a/g, seconded there by the very important and highest ranking provincial bureaucrat, Alan Seckel. What a shock it was to find that both Plant and Seckel just happened to have been partners in a prominent law firm, Russell Dumoulin, where--yes, surprise, surprise--they themselves held the authority a) to summons a loyal magistrate to survey the evidence; and, b) to appoint a special prosecutor by the name of wild billy berardino, who worked religiously with the rest of this cabal railroading the case away from revealing their biggest clients as the one who'd actually committed the BC Rail robbery.

Bandits by any other name.

Mary, I have no doubt that after the next election that the truth will come out. These crooks will never get back in power under the Liberal name. They will become Conservatives or invent a new party. They used to be Socreds and we all know what happened to them PRICKS. They are only motivated by greed, for themselves or there friends. I would like to see them brought to justice, but that will never happen. Maybe we can do what they used to do and take them out behind the shed where there is no one to protect there asses. You know if no one saw anything it didn t happen. Isn t that the principle they use. Oh what good teachers they have become, rob from the poor and give to the rich. Dosn t that sound familiar, Isn t that what Sadam and Momar did. I don t see any difference do you.
 
When I see BC being sold off to corporate interests and that the present system is set up to favour those interests over the people who live here, the only solution I can see is to fight for a vote on the issues. Yes, direct democracy, which serves so well in the extremely prosperous country of Switzerland. Here is a link to how it works:

True the article is about why Switzerland would want no part of the EU (and who does these day?) but it is also a useful primer on how their kind of system could work for us. Did you know that they are all armed and all trained by the military. That they all have automatic rifles in their houses? That home invasions are almost unheard of there? That if their government tries to pull a stunt like the Enbridge Gateway to Hell they have a RIGHT to vote on it?

I'm tired of being treated like an idiot by a government which has ulterior motives.
 
One should ask why 'high profile' and 'influential' politicians and their 'friends' would be having any truck with the likes of Basi, Virk and Basi and Bains in the first place.

It is not much of a stretch to suspect that the nouveaux riche, like Campbell and associates would see themselves as,or soon to be, were in my opinion participating in the kinds of games and pastimes that persons finding themselves in those heady atmospheres fall prey to.

Basi and Virk were tolerated because they were conduits to the products that the world of the other Basi and Bains brotherhood dealt in. who no doubt, in return for non interference, supplied ample quantities of their illicit but popular products to those 'movers and shakers' of the BC wannabee class.

Small wonder so many seemingly above reproach, high profile personages in all the hallways of that hallowed group, would want to quell any further intrusions or disruptions of their 'private' pursuits.

One of those 'upper echelon' players is well known for her 'leniency' toward others of the other Basi and Bains affiliation?

It wasn't the 'tip' of the iceberg that sunk the Titanic.

Thank you for a well-reasoned hypothesis, to which I'd like to add another piece of speculation, as follows:

another cousin of Dave Basi was a member of the Victoria Police Department. Dosangh was charged with counseling someone else about how to hide their drug money. He was arrested, charged, actually went to trial and was found guilty, and of course was fired from his job. So what? you may ask.

Well ... so his boss, the Chief Constable of VicPD who dispatched this problem efficiently and decently, was that top cop Paul Battershill.

And remember the hazing that descended upon Paul Battershill for no discernible reason? Media piled on him with nothing to report except that IF THEY COULD FIND SOMETHING, the penalties at trial would be terrible. Terrible! And journalists listed all the dire possibilities. Only they never found anything to charge him for.

Being less than 2 years from retirement, Battershill (who was in Halifax giving a key-note speech at a cop-convention when all this crap broke out behind his back at VicPD in Victoria) decided to take early retirement. More fatuous ink was spilled over that.

Then a sleuth in TC's team found that Mr & Mrs Battershill had retired to Kelowna (where they owned a house - some sleuth!), and that they had a fishing camp at Loon Lake where Battershill had taken on the job of Volunteer Fire Chief.

Ooo, can't you feel the chills of horror! Fire Chief of Loon Lake, ha ha, ho ho, etc. Well, it's worth a little romp through the BC Mary archives to see the warm, dignified letter to the Editor written by Mrs. B. That seemed to stop the nonsense ... maybe.

But I say: when you see a good man harrassed like this, you're wise to give these righteous wolves some 2nd thoughts. Most of us feel certain that not enough people were charged in the BC Rail Political Corruption Trial. Crimes have been left radio-actively simmering. Are they waiting for the Statute of Limitations to cancel them out, or something?
 
oops, I forgot to mention the most important point: Police Chief Paul Battershill was co-leader of the investigation of Jasmohan Singh Bains, therefore had to be a participant in the raids on the BC Legislature. But I don't know when he dropped out. Or how that happened.

We can speculate. Why would Victoria have such a hate-on for this exemplary cop?

Where you write "the case now going forward under Dohm." This is new to me. I'd like to hear more.

Thank you for your tribute to Robin Mathews for the great courage he shows. How true! And have you noticed that little by little, his startling revelations become verified as time marches on.

I'm going to cross-post your comment so that anyone too busy to click on it, can see it easily. Thanks again to all who have contributed to these excellent comments!

Sorry for the misunderstanding.

When i wrote, "the case now going forward," i meant to refer to those very important times in early 2004, when the legislature had been raided and the cops, under dohm's authority, had taken possession of evidence and were working on bringing charges from out of it all. It was to those days--from January 2003 to the laying of official charges--that i wished to evoke when i wrote of "now". Guess it all sort of comes alive for me right in around then.

Anyway, let me be clear that, at this stage, the only case dohm is going forward with is the one he carries full of golf balls when he's got a tee off time for later onwards at 29 palm springs.

No problem. I halfway expected that's what happened because the old scenes flash ALIVE so readily, as if they're at the ready.

I often think of that period too, and wish that I could make better use of the provincial library (b.t.w., where IS it now after Gordo the Wizard decided to demolish and "improve" it?).

Just the comings and goings might yield some surprises, registered for those days.

But my health won't allow even for that. Which tells you why I appreciate your comments so much.

Patrick Dohm, for a special example. I'd like to understand his role in all this, right from when Dohm asserted his authority over the raids on the Legislature, like, where did that authorization come from? Who called him in?

And why was he able to assume complete authority again, last year, when Elizabeth Bennett, the Basi-Virk judge who apparently wasn't "toeing the line" and so Dohm flounced into her courtroom and announced, over her head and in no uncertain terms, that not only must Bennett accept her "promotion", but her replacement by Anne MacKenzie was his choice, take it or leave it.

It looked so awkwardly weird: MacKenzie had other skills, but not the ones required for the BC Rail Political Corruption Trial. She simply didn't have the experience to undertake such a challenge.

So ... where did Dohm's hamfisted authority come from, to ram that through?

You have just explained why we need to have a brilliant, relentless, fearlessly independent scholar write the book on this tragic episode in the life of a beloved province.

Although I have no way of proving your sources, I accept what you've said as a credible hypothesis. And a good place to start work.

What is of interest to me is who replaced Battershill. Why that particular choice?

We look a lot like Alabama, which is considered one of the most corrupt sates in the U.S.A. What do B.C. and Alabama have in common, COAL. Although some decided Quebec deserved the title for Canada, I am of the opinion B.C. deserves it.

I don't know if we will ever find out what really went on but it sure would be entertaining if we did. We can't expect the MSM to publish anything because they have interests also.

All of it is about money, how to get their hands on Canadian resources, and keep everybody in line. When the international corps have what they want they will drop Campbell & his cronies. Maybe when it suits the international corps. we will learn the truth. Why else was Campbell invited to the Bilderberg conferance. Certainly not for his intellect. It was part of a process. They need people like him, to become their minions, to achieve their ends. In my opinion people like Campbell actually are delusional enough to believe they are being "welcomed" into "the group". What is being done is getting him to do their work, very willingly by appealing to not just greed but personal ego.
Christie Clark is just a replacement for Campbell, to "keep the lid on".

I don't expect to see a provincial election until international corps have wrapped up their business in B.C. or the end of their mandate comes.
 
I honestly don't think a the next govt,providing that the Fiberals lose, will be allowed to carry out justice. This,cover up is coming from higher authorities. RE: The Federal Liberals and the Sponsorship scandal...? Did the Concervatives pick up where the Liberals dropped off-NO! According to Justice Gomery 5 more individuals should have been arrested and it,"seems to have fallen into a black hole".

PS: whatever happened to Bill T's update on BVB???
