1. Determine if the MOU Applies to the Project Proposal
a) Determine if the project is a “major project” as defined in the MOU
Pursuant to section 30(1) of the Reviewable Projects Regulation, the proposed project will be
considered a “reviewable project” subject to the
Environmental Assessment Act (Act) as the
facility is a hydroelectric powerplant which will have a rated capacity of 50 MW or more of
electricity. The project is therefore a “major project” as defined in the MOU. The proponent will
be required to submit an application for a Project Approval Certificate to the EAO, and the
project will be subject to the environmental assessment review process set out in the Act.
b) Determine if the project is in the vicinity of WA
The proposed project is to be located within 100 km of the BC-WA border. Therefore it is
considered to be in the vicinity of WA, as defined in the MOU.
Since the project is a major project in the vicinity of WA, the MOU will apply.

Sorry to hear the chemotherapy kickback is lying you low today - still you scan the news and find the energy to post.

To me and many others you are a real BC hero for all you have done to inform us and fight for the truth about the criminal theft of BC Rail.

Please just know that you have inspired many and we all are pulling for you to get healthy.

Just wanted to say thanks for this information.

It's a good catch.

It's the official media release on the latest step in their march towards deep integration. A process i'm sure you see underway all around us.

They are quite obviously continuing on with their plans for further consolidation. They've just rolled in a new crew of front (wo)men to carry on with that very same agenda that BCR got caught up in. That's how we know this is no mere accident.

And if people have time, i recommend that they follow up and check out the references to the organizations mentioned below. This particular quote was plucked from near the bottom of the linked press release. Enjoy:

Mary, I'm so sorry about the dread chemo kickback. You deserve a break from that. But more importantly I hope things are on a good trajectory. You're a brave one in more ways that just one.

You have been a wealth of information, on the sleaziest crime in Canadian history. The BCR was stolen from us, and sold by Gordon Campbell. His corrupt team did aid and abet him.

Chemo does knock the stuffing out of you. Get lots of rest. We will wait impatiently, until you are better.

I would write to you privately, Don, except that I'm a wimp today and find everything an uphill climb.

Nothing unusual is happening to me considering the diagnosis given almost 2 years ago. I have a "fairly aggressive" cancer (breast cancer) for which there is no cure, only the possibility of delaying the progress. Which I've done, so far, and I love the bloggers too, so it's a win-win.

Strange, you know: I have no doubt that one day BC Rail will again belong to British Columbians. I mean, if we're so rich, why (at the height of our wealth) did we ever need to think of "selling" by hook or by crook?

Love you too, Don F., and my day brightens when I see your byline on my screen.

P.S. Leah, at the time of my diagnosis, sent me the following line of advice which I have followed ever since. I recommend it to all, whether a Cancer patient or whether trying to avoid being a cancer patient:

Remember, said Leah: Cancer loves sugar.
