B.C. auditor-general goes to court to get details of Basi-Virk defense costs

VANCOUVER - A decision is expected Thursday [that would be Thursday, August 11, 2011, ya think? - BC Mary] in the attempt by British Columbia’s auditor-general to get the details of the deal that saw the government pay $6 million in defence costs in the BC Rail political corruption trial.

On Tuesday [would that be August 9, 2011??], B.C. Supreme Court Justice Bruce Greyell reserved his decision in the case, which is a petition by Auditor-General John Doyle, who was represented in court by Vancouver lawyer Louis Zivot.

Doyle is seeking the information as part of his audit of the provincial government’s financial statements, which usually include an opinion on the statements, and which are normally released June 30. The case before the courts says that he cannot properly assess this year’s statements without the details of the $6-million settlement for former government aides Dave Basi and Bob Virk.

The auditor-general has formally requested the documents and has been trying to access the information for a long period of time, Zivot said.

The case initially included orders to obtain records held by government lawyer Richard Butler as well as documents held by Basi and Virk. However, Zivot said in court that the request for the documents held by the guilty pair would be adjourned, possibly until a later date.

The petition says Butler could not provide the information.

“Butler advised the office of the auditor-general that he could not comply with the request as the records and information sought were the subject of an agreement with the legal counsel for the respondents Basi and Virk that the entirety of their transactions and dealings was confidential,” read the petition.

The plea bargain came after government officials agreed to forgive $6 million in legal fees owed by the two men.

Hi Mary, Summertime I havent been so active, I check in here, I did a search re recent Court dealings, Did You now Leonard Krog went to Court this June to get the Documents and He succeeded.

" Leonard Krog, the Opposition Critic for the Attorney General, applies for an order granting him access to, including the entitlement to copies, of certain materials, including the Informations to Obtain the search warrants executed on December 28, 2003 in the investigation leading up to the trial in this matter, and to certain affidavits and other material, all filed during pre-trial applications (“Materials”). The Materials were released to certain media applicants earlier this year. "

[12] Mr. Krog submits the February Media Order does not restrict the media’s use of the Materials and there is no basis for restricting his use of the materials. Mr. Krog is a Member of the Legislative Assembly and his official role as Opposition Critic is to hold to account the Government and, in particular, the Attorney General. Mr. Krog says he should not be treated differently than the media applicants as there is no basis to conclude that his use of the Materials would cause harm or abuse to the administration of justice.

Soooo, if You go and read this Judgement I think You will seen that 13 Parties did not have a problem with releasing the Documents, why now are They saying the defendants do not want the documents released to Doyle ( I may be confused about this.

I just saw a brief report on this on Global BC.
Mike Farnworth commented saying pretty much anything we get is good for the public. I say we need to know it all. All the way to the top.

Yup, this is the corporate media doing their thing again, paving the way for some skulduggery to come soon from the government.

Probably getting ready to announce that they've slayed the BC Rail Scandal dragon by getting to the bottom of the $6 million payout to convicted felons, and (poof!) that's that. Problem addressed! Don't you worry about those guys in the murky background, shoveling billions out our back door, while the judicial coven watch in benign repose, and the NDs cower in nervous, confused silence.

Maybe this is the handiwork of BC's newly-minted Minister of Corporate Priorities. Gawd, can you believe that? Christy Clark creates a new ministerial position for Corporate Priorities??? Wait, surely that title has to be taken straight from Animal Farm, no?

I guess it's official now, the purpose of the BC government is to serve corporations.

I don't see any Minister for Citizen Priorities, do you?

All the allegations were proven, when Basi and Virk, in exchange for no jail time, no legal fees, were permitted to be saved harmless so long as they plead guilty, which they did.

Come on Mary, give us some news, not some screw-up.

I think it wanders off into actual news of the day, toward the end, doesn't it?

Uh-huh, just like the BC Rail contracts are "confidential", as are the proceedings of the caucus meetings that Paul Nettleton told us about. And the "third party" status of Mr Kinsella in re his lobbying activities.

Since when is the public's business only a "confidential" matter?

Secrecy is a tool of a totalitarian state, not a democracy.

And we all know where the BCSC sits on this; with their back to the truth, and no interest in serving the public, only their political masters.

Disgusting as usual, disappointing as always. No doubt the Auditor-General will either lose his position for bucking the lie - or get promoted upstairs like Loukedelis into a "thanks for that fatter paycheque, I'll keep my toes in line next time" job.
 
Mary, it reminds me of that Movie, JFK, where news about the assisination was broadcast in New Zealand, which should not have been possible, since the papers were printed before the assiniation even occured, or something like that.

THis is too wierd, what the F is going on is right.

Did someone say Krog was granted an Order to get info back in June?

If so, did he ever get the info, or did the respondant try and block the order, as they have 15 days to decide to do?

Christy Clark created a new ministerial position for Corporate Priorities alright.

And the person she hired to fill the post as the new deputy minister of corporate priorities, Athana Mentzelopoulos, was one of Christy Clark's bridesmaids.

I also notice that Christy Clark has just rewarded Craig James with a new job as Legislative Clerk.

His new job comes with a salary of $250,000 a year and is the top “non-partisan” staff position in the Legislature.

His new job starts next month right after he completes his mission of declaring that the HST is here to stay.

Does everyone remember his rejection of a recall petition because the acronyms HST and MLA put the word count over the allotted 200 words?

Declaring that the Liberals’ HST advocacy web site was not a violation of the Initiative Act, even though the RCMP thought it was?

Ruling that Fight HST could not use money raised for the petition to defend itself against a court challenge?

Allowing the Gordon Campbell government to have observers at the petition count, even though the government had failed to register as an opponent?

Firing deputy chief electoral officer Linda Johnson who had worked at Elections BC for 28 years?

Refusing to forward the successful petition to repeal the HST to the select standing committee until the judge ordered him to do so "forthwith"?

And now he's cashing in his loyalty rewards points.

A loyal servant of the current Campbell/Clark government.

Obviously the HST really isn't revenue neutral.

He is probably sunning himself in some idyllic location, but he does have good assistants who might answer with that information.

I don't hold my hopes up that the Auditor Gen is for the people. If this is the same as the John Doyle who ran Carrington Financial in Australia, which offered various services including:
•Share purchase through Macquarie Equities

We all know of MacQuarie, Gordo and the lieberals buddies.
You want to hope, but the connections throughout is mind boggling.

But, we must keep going. A full public inquiry is the only way to get to the bottom of this corruption.
 
Also, Bruce Clarks Lawyer signed the Order, note the even though Messrs is involved in the Auditor Generals Applications,Butler,no mention of him in earlier Judgement related to Krogs App.

They are both dated June 30th,though Krogs app was for June 2nd. Off to Doctor, hope to find more earlier, maybe pay 6 bucks, lol. Not sure if there is any publication ban on this, ha ha ha. [59] When Mr. Basi was served with the materials in support of this application he communicated via e-mail of June 23, 2011, with counsel for the Attorney General expressing his surprise to hear through the media he was opposing attempts by the Auditor General to obtain information. He advised that he had signed the release and waiver of confidentiality form. He stated in that e-mail:

Please note I do NOT object to the "request for access of records and information" as expressly specified in the letter to me dated June 3, 2011.

[60] He advised he did not intend to attend the hearing of this application as in his view his attendance would be "moot".

That gave Me My answer, Basi was Surprised through the media of He objectiong.

I agree with Chinese Sneakers' entire comment. I tried to convey a similar view in my earlier comment here (i.e. that this revealed some duplicitous action soon to be deployed), but I couldn't put it across as succinctly as CS does.

Especially enjoyed:

Now that's a more apt description of British Columbia today rather than the nauseating and embarrassing "best place on earth".

Why aren't We out on the streets to demand that OUR DEMOCRATIC RIGHTS BE REINSTATED!
DEMAND that OUR non-Justice (BCSC) system be investigated by an independent, made up of regular BC Citizens if possible?
